The objectives of the Minor Injury Guideline (MIG) are to provide immediate access to treatments and to ensure insurance companies will pay for these treatments promptly. Insurance companies can substantially reduce the amount of money they pay in a MIG claim.
The MIG limits the amount that an injured person can access to $2,200, or, with an extension, to an absolute maximum of $3,500. In some minor injury cases, this is sufficient. However, for many people, this amount is not nearly enough to pay for the treatments they need and to be able to function as they did before the accident. If an individual is removed from the MIG, then they may be entitled to a maximum of $65,000 in medical treatments.
“Tort Claims” or “Third-Party Claims” are initiated by your lawyer. This is a claim in law against a tortfeasor or the at-fault parties, which is usually handled by the tortfeasor’s insurer. In a Tort Claim, we will sue the tortfeasors for your injuries and damages. In addition, in Ontario, family members of an injured person may be entitled to claim losses under the Family Law Act. In a Tort Claim, you are entitled to pursue general damages for your injuries and special damages for your economic losses.
“Accident Benefits” or “no-fault coverage” are available to individuals involved in motor vehicle accidents under the Statutory Accident Benefits Schedule. The benefits that are available to insured persons vary depending on each case, the severity of injuries, and each specific insurance policy and its limits.
