If you are involved in an accident in Ontario, you should:
- Stop your car.
Never leave the scene of an accident without first reporting it and exchanging information.
- Call 911 immediately to report the accident and any injuries.
Explain to the 911 operator how the accident occurred, how many vehicles were involved, and if anyone is injured. Check on yourself and any passengers for any serious, visible injuries. If you or someone else has sustained serious injuries, is actively bleeding, or is unresponsive, inform the 911 operator and request an ambulance.
- Wait for and speak to emergency personnel.
Explain to the police how the accident happened. Be very detailed because it will help the police and insurance company determine the at-fault parties. If you have a dashcam, make sure to share the video with the police.
In minor accidents, police may not attend the scene of the accident. Instead, they will likely ask you to report the accident at the nearest collision center.
In more serious accidents, emergency personnel will provide immediate medical attention for your injuries, including taking the injured person(s) to the nearest hospital, if necessary.
- When it is safe to do so, exit your car and exchange information.
After you exit y our car, you must exchange information with the other driver. If there are multiple cars involved, make sure to get everyone’s information, including driver’s licence, insurance, and ownership details.
In addition, it is a good idea to obtain additional evidence, including:
- photos and videos of the accident scene;
- photos and videos of your injuries;
- dashcam footage from any vehicles involved (or nearby vehicles);
- name and contact information of any witnesses.
- Contact your insurance company as soon as possible.
It is very important to report the accident and your injuries to your car insurance provided as soon as possible. The insurer will assign a claim number. If you are injured, ask the insurer to open an Accident Benefits claim for your injuries.
- Seek medical attention and treatments.
Speak to your family doctor (or a walk-in clinic doctor) at the first available appointment. Report the mechanics of the accident, all of your injuries (physical, psychological, cognitive, etc.), and any limitations in your daily activities. If you are injured, your family doctor will likely refer you for necessary treatments, including physiotherapy, massage, and more.
- Consult a personal injury lawyer.
Last but certainly not least, it is a good idea to speak to an experienced personal injury lawyer. If you have sustained injuries, you will likely have questions about your rights, available benefits, and potential compensation in the future.
