Short answer

After a car accident in Markham, you can usually claim no-fault accident benefits for treatment and care, and — if another driver was at fault and your injury is serious — compensation for pain and suffering, lost income and future care. Tell an auto insurer within 7 days and start a lawsuit within 2 years. MAZI LAW represents Markham accident victims on a contingency basis.

Markham is a city of fast-growing neighbourhoods connected by some of the region's busiest roads. Highway 7 and its Viva rapidway run through the heart of the city, the 407 ETR and Highway 404 carry commuters across its southern and western edges, and arterials such as Kennedy Road, Warden Avenue, Woodbine Avenue, McCowan Road, Markham Road and 16th Avenue connect Unionville, Cornell, Markham Village, Cathedraltown, Berczy, Angus Glen, Box Grove and Milliken Mills. Steeles Avenue East, along the border with Toronto, is another frequent collision corridor.

MAZI LAW represents people injured in Markham collisions from our office at Yonge Street and Sheppard Avenue in North York, a short drive along Highway 404 or Steeles Avenue. Our practice is limited to personal injury and accident benefits, and we handle each claim from the first insurer call to the final settlement.

Markham collisions

Common causes of car accidents in Markham

Rear-end collisions

Stop-and-go traffic on Highway 7, 16th Avenue and the 404 ramps produces whiplash and back injuries every day.

Intersection crashes

Left turns across traffic and red-light running at large signalized intersections cause serious side-impact collisions.

Highway merges

Lane changes and merges on Highway 404 and the 407 ETR at speed can turn a small mistake into a multi-vehicle crash.

Distracted driving

Phones and in-car screens remain a leading factor in collisions across York Region.

Winter conditions

Snow, black ice and early darkness from November to March reduce stopping distances and visibility.

Pedestrians & cyclists

Busy plazas, school zones and Viva stops put people on foot and on bikes close to fast-moving traffic.

Crashes on city and regional roads in Markham are investigated by York Regional Police; collisions on Highway 404 and the 407 ETR are generally handled by the Ontario Provincial Police. Injury collisions — and any collision with combined damage over $2,000 — must be reported. People seriously hurt in Markham are commonly treated at Markham Stouffville Hospital, part of Oak Valley Health.

How accident benefits and a lawsuit work together

Ontario gives injured people two separate routes to compensation, and most Markham clients use both.

1. Accident benefits from an auto insurer

Accident benefits are paid no matter who caused the collision. Medical, rehabilitation and attendant care are included in every Ontario auto policy — up to $3,500 for injuries treated under the Minor Injury Guideline, up to $65,000 combined for other non-catastrophic injuries, and up to $1,000,000 for catastrophic impairments. For policies issued or renewed on or after July 1, 2026, income replacement, non-earner, caregiver and housekeeping benefits are optional and apply only if they were purchased, so the first step in any claim is reading the policy carefully.

2. A tort claim against the at-fault driver

If another driver was responsible, you can sue for the losses accident benefits don't cover. Pain and suffering damages are available where the injury is a permanent and serious impairment of an important function or a permanent serious disfigurement; in 2026, awards under $159,708.71 are reduced by a statutory deductible of $47,913.01. You can also claim past and future income loss, future care costs and housekeeping, and close family members may claim under the Family Law Act. Our guide to what a tort claim is explains the process in more detail.

Disputes

When the insurer says no

Denied treatment plans, insurer examinations that conclude you can return to work, and benefits cut off without a real explanation are common after collisions. These disputes are decided by the Licence Appeal Tribunal, and an application must be filed within two years of the insurer's refusal. MAZI LAW has successfully challenged denials of chiropractic care, dental treatment, assessments and Minor Injury Guideline decisions — our Tribunal decisions show the kinds of results we pursue for clients.

A common example: an insurer places a client's injuries in the Minor Injury Guideline and refuses anything beyond $3,500 of treatment. When chronic pain, a concussion or a psychological injury is documented, the Tribunal can order the insurer to fund treatment outside that cap, with interest on overdue amounts.

Deadlines

Time limits after a Markham collision

  • Within 7 days (or as soon as practicable): notify an auto insurer that you intend to claim accident benefits.
  • Within 30 days of receiving the forms: submit the accident benefits application.
  • Within 120 days: give the at-fault driver written notice of your intention to start a lawsuit.
  • Within 10 days: notify the City of Markham or York Region in writing if the condition of the road contributed.
  • Within 2 years: start a lawsuit, and start any Tribunal dispute within two years of a refusal.

Missing a deadline doesn't always end a claim, but it creates arguments an insurer can use against you. A free consultation in the first weeks after a collision is the simplest way to keep every option open.

First steps

What to do after a car accident in Markham

  1. 1

Get to safety and call 911 if anyone is hurt

On Highway 404 or the 407, stay in your vehicle with your seatbelt on if it isn't safe to get out.

  2. 2

    Exchange information and gather evidence

Names, licence plates, insurance details, photographs of the scene and vehicles, and contact details for witnesses. Note any dashcam or business cameras nearby.

  3. 3

    Report the collision

Report to police, and keep the report or incident number for your insurer and your lawyer.

  4. 4

Get medical care and follow it

See your family doctor or a walk-in clinic within days and attend recommended treatment — gaps in care are used to argue an injury is minor.

  5. 5

    Speak with MAZI LAW

We handle the insurers so you don't have to give recorded statements or sign releases without advice.

Markham car accident lawyer — FAQs

It depends on the severity and permanence of your injuries, your income loss, the treatment and care you will need, and how fault is shared. We assess all of these after reviewing your medical records and policy — at no cost to you.

Accident benefits are a no-fault coverage, and premiums in Ontario are mainly affected by at-fault findings under the Fault Determination Rules rather than by claiming the benefits themselves. Your broker or insurer can confirm how a specific claim affects your policy.

Most claims settle without a trial. Accident benefit disputes go to the Licence Appeal Tribunal, and many tort claims resolve through negotiation or mediation. We prepare every file as if it may go to trial, because that is what produces fair settlements.

Your own auto policy includes protection for collisions with uninsured and unidentified drivers, and the province's Motor Vehicle Accident Claims Fund may respond where no insurance applies.

Nothing upfront. We work on a contingency fee — you pay only if we recover compensation. See our legal fees page.
